RTIwala Trending: Nirav Modi and Mehul Choksi are the talks of the town these days. The CBI, after a complaint by Punjab National Bank, have declared them defaulters. The Ministry of External Affairs suspended the passports of both the protagonists.

Who are Nirav Modi and Mehul Choksi?

Nirav Modi is the name famous among the Bollywood celebs is one of the famous jewelry designers running a brand under his name as ‘NIRAV MODI’. He is the third-generation of his family, who grew up in Belgium, where his father still runs a diamond business. He had been a dropout of Wharton and moved to India to learn the ropes of the diamond trade from his uncle Mehul Choksi.

Nirav has founded his own diamond sourcing and trading company named as Firestar which is valued over Rs.6400 crore. There are three more companies that are owned by Nirav and his relatives they are Diamonds R US, Solar Exports, and Stellar Diamonds.

Mehul Chinubhai Choksi is Nirav’s uncle and owns jewel firms name Gitanjali Gems, Gili India and Nakshatra brand. The Central Bureau of Investigation has looked out for four accused Nirav, his wife Ami Nirav Modi and his brother Nishal Modi and Uncle Mehul Choksi all of them have left for abroad during the first week of January. Ami is said to be an American citizen, while Nishal is a Belgian national.

Nirav Modi and his Uncle Mehul Choksi came into limelight when Minister of External Affairs suspended the validity of their passports after the advice of Enforcement Directorate department. As the suspects are out of the country the ED has advised the MEF to suspend their passport at earliest. Both of them have been asked to respond within a week. The investigation agencies, banks, and the Interpol all of them have tightened the noose around billionaire diamantaire Nirav Modi who’s fraud of Rs.11, 400 crores have been detected at Punjab National Bank.

While making an investigation at Nirav’s and his relative’s properties, the agency seized diamonds, jewelry, gold worth Rs.5100 crore. This included some bank fixed deposits and documents relative to import bills. The CBI has conducted searches against Choksi across 20 locations in Maharashtra, Gujarat, Rajasthan, Telangana, and Tamil Nadu. And also the PNB officials who were found accused in this whole conspiracy are under custodial inquiry.

Will such scams results to some conclusion or they will be merely a piece of cake over political debates?

These scams come and go and become a topic of discussion for political parties for a while. Now it is being stated that it is ‘banking fraud’ and not a ‘government fraud’. One party blames the other that this is the scam that happened in the opposition party but came to light when they revive the new banking system in their government.

Such issues last forever and no final conclusion has ever been drawn. Big thieves hide abroad and on the other hand, an investigation is said to be continued without digging out any effective result.

What makes the event so prominent?

Auto Expo in India is one of the largest gatherings of the auto manufacturers in India that the world is eagerly waiting for. It used to be held at the India Expo Mart in Greater Noida, New Delhi. This time it will showcase many hybrid/electric vehicle versions and super-fast bikes of the big names like BMW, Yamaha, etc. This is the 14th edition of the biennial Auto Expo which will unveil 100 of new vehicles with 24 new launches.

Maruti Suzuki Swift launched in India with a price launched from Rs.4.99 Lakh which is Rs.20,000 more than the previous version boasting of better features, performance, and fuel efficiency figures. Same is the case with the new Facelift launched by Hyundai i20 Elite whose price starts at Rs.5.34 lakh with Google Play Store and Apple android functionalities.

Why is the Supreme Court set to Re-Examine Section 377 of IPC?

RTIwala Explains: The Supreme Court is all set to reconsider the Section 377 of the Indian Penal Code (IPC). The controversial section is based on criminalizing homosexuality. Owing to fresh petitions relating to the citizen’s Right to Privacy, the country’s apex court has decided to review earlier judgments.

What is Section 377 of the IPC?

The Section 377 of the Indian Penal Code was introduced during the British Rule and criminalizes “sexual activities against nature”.

“Section 377 of the IPC refers to ‘unnatural offences’ and says whoever voluntarily has carnal intercourse against the order of nature with any man, woman or animal, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to pay a fine.”

The case came into the limelight in the year 2009 when it was decriminalized by the Delhi High Court. The judgment was then overturned by the Supreme Court of India on 11 December 2013, amending or repealing that it should be decided by the Parliament and not the judiciary.

The petition for the case was filed by five people who belong to the LGBT community. They were affirmative on the note that when the Supreme Court has itself declared the Right to Privacy being a fundamental right, they cannot be denied their right to sexual privacy. The petitioners said that they lived in a state of fear because of Section 377 and that the 2013 judgment ignored harassment and problems arising out of the law.

In a largely conservative Indian society where homosexuality is considered as a taboo, the common man seems to be divided on the controversial issue. The Supreme Court bench had a previous observation that the earlier judgment on section 377 had hurt the sentiments of many people. Here’s what the debate comprised of:

‘What is natural to one, may not be natural to the other’.

The bench further said that “societal morality changes with time and law walk with life. A section of people can’t live in fear because of their individual choices”. The court has asked the petitioners to provide a copy of the petition to the central government office. The ‘Right to Privacy’ states for the right of living of a human without being discriminated on the basis of sexual orientation, as it is deeply offensive to the dignity of the individual.

The five main protagonists who filed the petition are Bharatnatyam dancer Navtej Johar, culture expert Aman Nath, restaurateurs Ritu Dalmia and Ayesha Kapur and media person Sunil Mehra. They believe that SC’s this action will bring back them some hope and societal life with complete dignity.

The society is comprised of freedom loving people who may not be belonging to the gay-community want homosexuality to be decriminalized but on the other hand many still consider it a “deviant behavior”.

Be it an LGBT person or not, humanity is what matters the most. Every individual is a human being and has a right to live life as per their choice and with due respect. The violation of such human rights goes against the liberal values of the Constitution.

Meanwhile as the final call rests in the hands of the apex court of the country, we sincerely hope that no right of any individual would be held in jeopardy.

Who was Rukhmabai…?

Rukhmabai Raut was one of the first female opted for Medicine apart from Anandibai Joshi, Kadambini Ganguly and Chandramukhi Basu. She was on November 22, 1864, in a Maharashtrian (Marathi) family to Janardhan Pandurang and Jayantibai who came from a community of carpenters (Sutars). She was one of the bold and progressive women of that time.

She was famously known for her stand towards legal separation (then divorce) and love for higher studies in medicine. She was also at the heart of a landmark legal case which led to the enactment of the Age of Consent Act, 1891.

1. Rukhmabai was a victim of child marriage as she was married at the age of 11 to 19-year-old Groom Dadaji Bhikaji after her father died when she was just 8 years old.
2. Rukhmabai’s Mother Jayantibai transferred her property to Rukhmabai who was only eight and she remarried after her daughter’s marriage to Dr Sakharam Arjun, and the step-father supported Rukhmabai at every step.
3. She refused to live with her husband and maternal-in-laws who were after her property she inherited from his deceased father.
4. She fought a long legal case against her husband after marriage and won the case. This judgment was also criticised by Bal Gangadhar Tilak and other prominent Hindu leaders.
5.  Rukhmabai wrote numerous letters in the newspapers under the pseudonym A Hindu Lady particularly the Times of India, which stirred the support and public sentiments in her favour.
6. A fund was created to support her travel and study in England at the London School of Medicine for the 5 years degree course.
7.  Rukhmabai returned to India in 1894 and joined a hospital in Surat as the First practising female doctor in India, where she served as the chief medical officer for 35 long years. She retired around 1930, and eventually, breathed her last in 1955, at the age of 91.

He was sworn in as Union Minister of State, Commerce in 1985. Late Priya Ranjan Dasmunsi was the cabinet minister in Ministry of Parliamentary Affairs and Ministry of Information and Broadcasting during the first term of Prime Minister Manmohan Singh.

When and How Priya Ranjan Dasmunsi Died?

The Congress Statesman suffered a massive stroke on October 12, 2008. which left him partially paralysed and unable to speak. Blood supply to a part of his brain was cut off causing irreversible damage. His body systems were functional but he breathed through a tracheostomy tube attached to his neck and was fed through a PEG tube in his stomach. All basic life functions like breathing, blood pressure, sleep-wake cycle were stable but he was not conscious of his surroundings.

Mr PR Dasmunsi (72), died at 12.10 p.m. today (Monday). He had been critically ill for the past one month and unfortunately succumbed to his illness, said Apollo Hospital in a statement.

1. Late Dasmunsi was the first Indian to be a match commissioner in a World Cup match in 2006.
2. Dasmunsi also served as the President of the All India Football Federation (AIFF) for almost 20 years.

4. He entered the Indian Parliament in 1971. He was sworn in as Union Minister of State, Commerce in 1985.

ASEAN Summit in Manila: Who, what and why?

RTIwala Trending: The Philippines is playing host to the 31st ASEAN Summit and Related Summits. The Rohingya refugees issue, the South China SEA tussle and the rise of radicalization and extremism are expected to dominate the limelight. Leaders from the 10 ASEAN member countries and its dialogue partners will gather here for the important summits hosted by the Philippines. The member countries are Australia, China, India, Japan, New Zealand, South Korea, Russia, United States, Canada, and The European Union. The United Nations Secretary-General will also attend the conference.

ASEAN, a ray of hope?

“Partnering for Change, Engaging the World,” is the theme for the conference. Philippine President Rodrigo Roa Duterte will chair the plenary session of the 31st ASEAN Summit. ASEAN Leaders will discuss the implementation of the ASEAN Community Vision 2025 and the way forward. The appointment of the new Secretary-General of ASEAN will also be considered. The three-day summit also coincides with the provincial bloc’s 50th anniversary.

Undersecretary Enrique Manalo of the Philippine Department of Foreign Affairs chaired a meeting of ASEAN Senior Officials in Clark, Pampanga. The meeting was held to discuss arrangements for the Summits and finalizing outcome documents. The documents are likely to comprise of innovation, cybercrime, malnutrition, and protection of the rights of ASEAN migrant workers. The Malaysian delegation will be led by Prime Minister Datuk Seri Najib Razak. He is expected to arrive after participating in the ongoing Asia-Pacific Economic Cooperation (APEC) in Danang, Vietnam.

US President Donald Trump will attend the meeting, along with Chinese Premier Li Keqiang, Japanese Prime Minister Shinzo Abe, South Korean President Moon Jae-in, Indian Prime Minister Narendra Modi, Indonesian President Joko Widodo and Myanmar State Counsellor Aung San iSuu Kyi. The host, Philippines is fighting insurgents in the city of Marawi. It is mobilizing around 60,000 security personnel to help secure the Summits and the high profile foreign visitors.

The ASEAN leaders will also sign the ASEAN Consensus on the Protection and Promotion of the Rights of Migrant Workers. It is a milestone document that further seeks to reinforce social protection, access to justice, humane and fair treatment, and access to health services for the migrant workers of Southeast Asia.

Singapore will assume the chairmanship of ASEAN in 2018. It will be significant to see first of its kind combination since the idea of a quadrilateral grouping. It involves Japan, U.S., Australia, and India that seems to have taken shape. Google Removes Videos from YouTube. But why?

RTIwala Trending: Google, in the last few months has removed extremist videos from YouTube. The videos that depict violence or preach hate have been removed as a move by the authorities. A major policy shift has risen up for YouTube, as social media companies face increasing pressure from governments. The new policy will affect videos that feature people and groups that have been designated as terrorist by the U.S. or British governments. Also, the videos that lack the gory violence or hateful speech that was already barred by YouTube have been removed. A YouTube spokesperson confirmed the policy in response to questions. The company would not be specifying the time when the policy went into effect.

Why the takedown?

YouTube has terms that already barred “terrorists” from using the service. The new policy keeps out videos uploaded by other militants who likely would try to distribute if they could have accounts. Hundreds of videos of Al Qaeda recruiter Anwar al-Awlaki lecturing on the history of Islam were among those that have been removed under the new policy. The video was recorded long before he provoked violence against the United States. Governments and human rights groups have pressed YouTube for years to chink down on extremist videos. They quarrel on the basis that the propaganda radicalized viewers and contributed to deadly terror attacks.

British Home Secretary Amber Rudd augmented the pressure during visits with tech companies in Silicon Valley in July along with a speech in Washington, D.C. last week. The European Union and U.S. lawmakers have time and again threatened consequences for tech companies if concerns are not addressed as soon as possible. A German law was approved in June to fine social media companies 50 million Euros ($57 million) if hateful postings were not promptly removed.

YouTube said discussions with outside experts prompted the new policy. However, it was unclear why the company decided to act only recently. In June, the company announced that “inflammatory religious or supremacist content” that did not violate its policies would be allowed with warning labels and a restriction making them ineligible for ad revenue.

The latest step was praised by the likes of critics such as Paul Barrett. He is the Deputy Director of the New York University Stern Center for Business and Human Rights. “If the terrorist is in the business of recruiting and inciting people to make violent attacks, you’ve got to the draw the line against any of their content”, Barrett said.

The new policy does not affect in any way the news clips or educational videos about terrorism. However, YouTube will not always have an easy time distinguishing. The pointing to tactics such as overlaying extremist commentary on news footage to get around censors will be hard to discover. YouTube has resisted imposing more editorial control. It fears that it will make it harder for important videos to get a wide audience.

Internet freedom advocates such as the Electronic Frontier Foundation have urged tech companies to be vigilant and clear as crystal in responding to government pressure. YouTube is relying on government lists of terrorists and terrorist groups for enforcement. Content moderators check the list and make removal decisions after fielding information from an automated system. It may be users or partner organizations such as the Anti-Defamation League and The Institute for Strategic Dialogue.

Kapil gets candid on his health issues

At the trailer launch of Firangi, Kapil had spoken his heart out. He told how difficult life had turned out to be in recent times for him. He had also shared and confessed that he was depressed and developed suicidal tendencies. He gave the credits to his friends who managed to pull him out of it. Talking about how panic attacks got his work to suffer, he told media, “I could not step on the stage to perform and would cancel the shoot. I suffered from anxiety and drank myself silly. I would stay locked up in the office with my pet dog. People stopped coming on the show and I went off the radar.”
